DOL files Notice of Appeal on OT regs
The U.S. Department of Labor on Thursday filed a Notice of Appeal to the Fifth Circuit Court of Appeals challenging the district court judge's order blocking changes to the Overtime Final Rule.
The court could grant a motion for an expedited hearing or a motion for a stay -- which would make the rule take effect -- but the appeal process could be lengthy. An article from the Society for Human Resource Management indicates that without an expedited hearing, briefs on the case likely wouldn't be filed before Inauguration Day on January 20, 2017.
